Lawsuit Filed Against Unconstitutional Omnibus Bill; Will Courts Stop the Corruption?

At the end of the state Legislature’s session in May, we witnessed the most tyrannical abuse of legislative authorities in the history of our state. Corrupt Democrat legislators, led by radical, big government leftists Melissa Hortman, Erin Murphy, and Bobby Joe Champion, passed a nearly 1,500 page bill (HF5247) that ADMITTEDLY combined 9 different pieces of legislation! 

During the debate on this bill GOP Senator Jeff Howe had the floor and never relinquished it back yet it was steamrolled through and passed illegitimately in both chambers. This bill was a conference committee bill which requires the complete legislation be approved by the appointed committee, which was not done. The State House and State Senate each erupted into chaos over the blatant corruption.

Despite being obviously unconstitutional and corrupt, Tim Walz signed this bill, further rubber-stamping the St. Paul Swamp’s disdain of voters, taxpayers, our freedom, and our Constitution. As Walz is under VP consideration, read the full report of his crooked record.

The only recourse that can be taken to combat this insane bill at this point is a lawsuit. In a specific attempt, UnitedHealth Group filed a lawsuit in a state district court on Aug. 2nd against the MN Dept. of Human Services arguing that HF5247 violated the ‘Single Subject Clause’ of the MN Constitution (Article 4, Section 17) which reads “No law shall embrace more than one subject, which shall be expressed in its title.” This was clearly violated because the bill title itself is six pages long and at least nine bills were combined to create it!

UnitedHealth Group accurately labeled this bill as the “Jumbo Omnibus” and says provisions in the bill harm how they can do business with for-profit Health Maintenance Organizations (HMOs). Unfortunately, this is the crux of their lawsuit as their complaint states they bring to the suit to “have the provision declared unconstitutional under the Single Subject and Title clauses and stricken from law.” 

In short, this lawsuit would repeal a tiny section of this corrupt bill BUT if successful, it will provide judicial acknowledgment of this bill’s unconstitutional nature so that it can be fully repealed in the future!

While it is nice to FINALLY see RINOs voting against and fighting omnibus bills, they only do that when the Democrats are in charge. When the Republicans are in charge, it is business as usual with the GOP’s own unconstitutional, multi-subject omnibus bills! Career politician RINOs such as Greg Davids (26B), Brian Johnson (28A), and Ron Kresha (10A) are a few to blame, as they have carried the Establishment’s water for a combined 53 years in the State House! From our previous scorecards and their abysmal voting records (while the GOP has control) throughout the years, it became clear to conservative voters that electing the same old politicians will never give you new results. The big government, liberal omnibus bill votes these RINOs have taken over the years has led MN down a path of Constitutional ruin and voters have become awake to this.

RINOs Greg Davids and Brian Johnson were each handedly defeated by large margins on the first ballot during their endorsing conventions. The local conservatives in these deep red districts lost faith in their representatives to fight for their interests. In the case of House District 10A, Rino Ron Kresha’s conservative primary opponent, Aitkin Co. Patriot Diane Webb-Skillings, was able to withhold the endorsement from Ron and has landed coveted endorsements from elected conservatives, candidates, and local activists. In our survey sent to both candidates in 10A, Diane stated she would NEVER vote for unconstitutional omnibus bills. Meanwhile, RINO Ron voted for them and refused to return the survey!

Another sad dose of irony in this is that a MNGOP sub-unit, House Republican Campaign Conference (HRCC), has sent a number of mailers for these unendorsed RINOs which violates the state party Constitution! The HRCC is clearly not committed to winning a majority in the State House and is instead an incumbency protection racket! One would think HRCC Chair Josh Heintzeman would have the common sense to target swing districts instead of red district primaries, however, Heintzeman was dumb enough to knock on Erik Mortensen’s door and try to convince his wife to vote for Mort’s opponent Boozin’ Bob Loonan! He was even caught on their Ring doorbell camera! With that in mind, we will NEVER falsely accuse Heintzeman of being strategic, smart, or pro-liberty!

Several HRCC mailers for incumbent RINOs have even included the MNGOP on the disclaimer! The participation of the MNGOP in this HRCC mailer has since been denied by MNGOP Exec. Director Anna Matthews. The latest HRCC mailer for RINO Ron Kresha does not list the MNGOP in the disclaimer like one prior, however, the MNGOP must take immediate action to force the HRCC to comply with Endorsements or their party unit status will be REVOKED! Action 4 Liberty will continue leading the fight against the rampant corruption in our state!
