Lobbyist Legislator Kurt Daudt, who serves as the Republican Minority Leader in the Minnesota House, made a motion on Wednesday in the House Rules Committee to advance a bill that would put the Governor's Unilateral Emergency Powers in the State Constitution. HF101, authored by Rep Steve Green, is a proposed Constitutional Amendment that codifies the unilateral powers of the Governor granted under state statute into the Constitution, then requires a simple majority to extend them. In other words, if Democrats were in complete control of the legislature, Minnesota could experience permanent Emergency Powers like we have right now.

This bill stands in stark contrast to Rep Erik Mortensen's Never Again Bill, or Unilateral Emergency Powers Repeal Act, which would strip the Governor of his ability to unilaterally call an Emergency. Mort's bill goes further and requires a 2/3 majority to declare an emergency, ensuring that emergency matters are non-partisan. On top of that, the Never Again Bill removes the Governor's order from being treated as law and has a Bill of Rights for Emergencies. None of those parts are found in Rep Green's bill that Daudt tried to move in the committee.

HF101 clearly has the support of the Old House Republican Caucus leadership, who are silent on Mort's Never Again Bill. Reps Lucero, Pfarr, Bennett, Daniels, Bliss, Burkel, O'Neill, Quam, Novotny, Erikson and Poston are all co-authors on the bill. The Senate Companion bill is authored by Sen Utke. 

Action 4 Liberty stands strongly opposed to this Fake End Walz' Powers Bill. Republicans in the Legislature need to fight to FIX the problems of Emergency Powers, not codify them in our State's Constitution. We call on the Legislature to pass no budget and make no deals with Governor Walz until his current Emergency Powers are terminated and the Never Again Bill is passed!

House Majority Leader Ryan Winkler, also known as the DFL Party Boss, said you and I are just trying to "score some political points" in calling for the End of Walz' Emergency Powers. 

WRONG!

We are trying to score on THE MOST important political point of our lifetime - should we reject our Constitutional Republican form of government so one man can rule over us by his unilateral declaration of an emergency. And the obvious answer is...HELL NO!

While Winkler is busy telling Julie Sandstede, Dave Lislegard and Paul Marquart how to vote, we're busy informing their voters that they are bought and paid for by the Metro Democrat Machine. And it's having a huge impact!

In fact, it's not good enough to just End Walz' current Emergency Powers, but we MUST ensure that they NEVER HAPPEN AGAIN!

That's why we introduced the Never Again Bill which would eliminate Governor Walz and future governors from unilaterally declaring an emergency. On top of that, the bill punishes a Governor with fines or jail time for infringing on our rights. And it also protects our small businesses by ensuring we all have a right to operate a business and earn income during emergencies. 

Rep Erik Mortensen's Never Again Bill, known officially as the Unilateral Emergency Powers Repeal Act, just gained momentum by getting introduced in the Minnesota Senate today. SF 2356, authored by Sen Mark Koran, is the Senate version of the Never Again Bill.

If passed into law, the bill would change the Emergency Powers laws in the state so Governor Walz and future governors can't take unilateral control over law-making and shut down businesses, churches and lock citizens in their homes. The bill also would create penalties for the Governor or government agents who do not adhere to the law. And the rights of Minnesotans are further spelled out in a Citizens' Bill or Rights for Emergencies which prohibits government from not allowing an individual to earn income or run a business.

This bill has wide appeal. Gubernatorial candidate Mike Murphy signed the Never Again pledge which states his highest priority is passing it if elected to office. Although candidate Scott Jensen won't sign the pledge, he did call on the Legislature to not pass a budget until the Never Again bill is signed into law. 

All eyes are on Senate Majority Leader Paul Gazelka now. As he starts meeting with Walz and Democrat leaders behind closed doors to negotiate a $52 Billion budget, it's on him to stand firmly against spending one dime of our money until the Never Again bill passes. If Walz wants his government funded, it's time he loses his unilateral powers to declare an emergency!

WHO IS MY SENATOR

"Sheriff, I want you to take all reasonable, rational and safe methods to arrest Mrs Hanson. We need to move this case along."

That's the statement made by Third District Court Judge, Joseph Bueltel, this afternoon in an Order to Show Cause hearing for Freeborn County Sheriff, Kurt Freitag. As we reported earlier today, an arrest warrant for Lisa Hanson was issued by the judge on March 11th, but so far has not been executed by the county sheriff. The whole matter stems from Mrs Hanson, the owner of the Interchange Bistro in Albert Lea, defying Governor Walz' illegal and unconstitutional orders that discriminately shut down portions of the state economy, like bars/restaurants, while allowing big box stores to remain wide open during the busy Christmas season.

Freeborn County attorney David Walker initially challenged the merits of even having today's hearing. The state's case led to confusion with mistaken dates on an affidavit, conflicting information and incorrect sworn testimony by the Albert Lea city attorney.  Things started looking good for Lisa's case when the county attorney argued that the Chief Justice of the Third District gave authority to sheriffs in quashing misdemeanor warrants. However, both the county and opposing council appeared to quickly resolve the case against the sheriff as long as Mrs Hanson is apprehended in the next two weeks and brought in front of the court.

In other words, everyone in today's hearing was trying to save their own butts in the ugly and messy proceedings, while Lisa Hanson's freedoms became the sacrificial lamb. This case would not be in front of the courts had the Third District Court or the Walz' Administration respected our rights in the first place. Because Governor Walz' exercised unilateral, unchecked Emergency Powers to force businesses to close, Lisa now is facing her first arrest of her lifetime. And it's really sad that a small business owner, mother and patriot is now going to be placed in cuffs because in one year, our state has traded in its Republican form of government for the new normal of authoritarianism. 

Meanwhile, 20 minutes south of Lisa's hometown, businesses were fully open.

Action 4 Liberty calls upon Senator Paul Gazelka and Senate Republicans to not pass a budget bill unless Walz' Emergency Powers are terminated and the Never Again Bill passes. We must ensure that this NEVER HAPPENS AGAIN!

A judge in Southern Minnesota has issued Freeborn County Sheriff Kurt Freitag a summons to appear to court today because he has not executed an arrest warrant for the owner of the Interchange Bistro in Albert Lea, Lisa Hanson. Freitag courageously stood for the rights of his constituent who has unlawfully been attacked by the Walz' Administration and local court system for, get this, opening up her restaurant in defiance of Governor Walz' illegal executive orders back in November of 2020.

If you remember, Walz discriminately shut down part of Minnesota's economy last fall. He targeted gyms, restaurants and bars, while big box stores remained fully open and packed for the holiday season. Action 4 Liberty told the heroic stories of Larvita in Lynd, Jane in East Grand Forks and Lisa down in Albert Lea - business owners who defied the Governor's illegal orders and opened up.

This courageous act was immediately punished by Dept of Health Commissioner Jan Malcolm's office with outrageous fines and revocation of liquor and food licenses. Attorney General Keith Ellison, representing the Dept of Health, got liberal judges across Minnesota to force these businesses to shutdown and in some cases, found them in contempt of court.

Five months later, these business owners are still seeing the punitive nature of their government as they continue to have their licenses suspended and in the case of Lisa, an arrest warrant issued for her not showing up to a court hearing. It appears the court did not properly follow the rules in notifying Hanson of the court hearing, which is why she was not present. 

Hanson's record shows an arrest warrant issued on March 10th.

The court, and Governor Walz' Administration, want local law enforcement to do their dirty work for them. In Lisa Hanson's case, it's up to her Sheriff, Kurt Freitag to make the arrest. But Freitag does not seem interested in violating the rights of his constituents for an egregious act of government stepping over the line of its constitutional authority. 

Action 4 Liberty supports Sheriff Freitag for standing up for the Constitution and rights of his constituents. Sheriffs play an important role of being one of the last lines of defense against government tyranny.

After a lengthy discussion on Saturday with Scott Jensen about why he would sign the Never Again Pledge, he did agree to the bare minimum, and called on the Democrat House and Republican Senate to not pass the budget until Walz' Emergency Powers are gone and the Never Again Bill is passed.

You asked for one simple thing: a pledge, a signed commitment, for the next Governor of Minnesota to clearly state that abusive, unilateral Emergency Powers will NEVER HAPPEN AGAIN! 

In politics, talk is cheap. Every candidate trying to earn your vote will utter carefully crafted talking points making you think they are on your side. But when push comes to shove, they won't be there for you when it matters the most.

We tried working with Scott Jensen last May when he dropped the End Walz' Emergency Powers Resolution. We asked him if this was just another stunt like his Gun Control bill where he was just "having a conversation" or was he being serious. 

Remember, last May our beloved businesses were still shut down and people weren't suppose to travel unless it was for an "essential" job. Jensen's failure to bring forward a vote ensured we would face at least another month of Walz' tyranny. Turns out, it lasted more than a year!

Instead of courageously standing up to Party leadership and forcing the vote, Scott Jensen cowered. Here's our write up from last May.

Once again, Jensen REFUSES to take the courageous stance and sign the NEVER AGAIN PLEDGE! 

Scott Jensen is sending a clear signal to YOU that he is not serious about Ending Walz' Emergency Powers. 

If he was truly serious, he wouldn't sidestep this pledge. This means that Scott is only willing to pay lip service on this issue.

You know the saying: "Fool me once, shame on you. Fool me twice, shame on me."

Politicians like Scott Jensen don't sign pledges because they want wiggle room when dealing with the radical left. They're always more concerned with how to compromise than standing firmly on their values. 

Do you know Scott Jensen also REFUSED to sign the pledge to never raise your taxes? At the end of the 2019 Legislative Session, Jensen and other Republicans caved to Walz and the radical left, and increased YOUR taxes. Here's our article from May of 2019 with the vote.

But Jensen also doesn't seem to want to force this issue to the front of budget negotiations. Which is one of the strongest parts of the pledge. Imagine the pressure on the Senate Republicans if the Party's gubernatorial candidates are calling on them to not pass a budget without passing the Never Again Bill?

That's called negotiating from a position of strength! Which is something lost on most Republicans in this state. 

But I do have some good news. The other candidate in the race just signed the pledge!

That's right. There is a candidate that has shown courage to stand up and do what's right and what is needed.

Liberty champion Rep Erik Mortensen introduced a bill called the "Second Amendment Preservation Act" in February that's gaining some recent traction as the threat of federal gun control laws grows. His bill nullifies federal legislation or executive orders issued by President Biden that infringe on the right to keep and bear arms. Mort's bill has picked up 6 co-authors in the House, including Rep Shane Mekeland last week.

HF 1265 defines infringements of the 2nd Amendment as:

(1) any tax, levy, fee, or stamp imposed on firearms, firearm accessories, or ammunition not common to all other goods and services and that might reasonably be expected to create a chilling effect on the purchase or ownership of those items by law-abiding citizens;

(2) any registering or tracking of firearms, firearm accessories, or ammunition that might reasonably be expected to create a chilling effect on the purchase or ownership of those items by law-abiding citizens;

(3) any registering or tracking of the owners of firearms, firearm accessories, or ammunition that might reasonably be expected to create a chilling effect on the purchase or ownership of those items by law-abiding citizens;

(4) any act forbidding the possession, ownership, or use or transfer of a firearm, firearm accessory, or ammunition by law-abiding citizens; and

(5) any act ordering the confiscation of firearms, firearm accessories, or ammunition from law-abiding citizens.

Mort's bill also clearly states that federal bills that meet the above criteria "shall be invalid in this state, shall not be recognized by this state, shall be specifically rejected by this state, and shall be considered null, void, and of no effect in this state." It further specifies that state and local law enforcement cannot be used to enforce the unconstitutional federal laws or orders.

You know the joke that, at times, seems all too real: how do you know a politician is lying? Their lips are moving!

Last May, the legislative session was winding down while Governor Walz' tyrannical orders were still in place. Our beloved small businesses were under a shutdown and people could not attend their churches. Fearing we'd enter the summer without any reprieve from these abusive powers, we demanded the Republican controlled Senate pass the End Walz' Emergency Powers Resolution.

If you aren't aware, the Constitution of Minnesota required the Legislature to finish business by May 18th. After that, they could only be called back for a Special Session at the request of the Governor.

So as the final weekend approached, we called then Senator Scott Jensen to make a motion on the Senate floor to get a vote on the End Walz' Emergency Powers Resolution.

Guess what he did?

Instead of taking the courageous stance and forcing the vote on the Senate floor, he took the issue to a private caucus meeting, where Senator Gazelka decided to kill it. Jensen could have fought for us and forced a vote, rather than bow to Party leadership. But he was apparently too worried about putting his colleagues (aka politicians) on record, which would've exposed them for the whole public to see.

As you can see, he took NO ACTION to force a vote when we needed him the most. Now he's running for governor, whispering sweet nothings in our ear and begging for our votes. But I say we demand action!

Scott Jensen has done countless media appearances, been outspoken about the government's COVID response and is officially a candidate for Governor. He's trying to sell himself as the answer for Minnesota. But has he changed?

There is only one way to tell if candidates like Scott Jensen, Mike Murphy and anyone else who enters the Governor race are serious and willing to put pen to paper. They need to PLEDGE TO YOU that they will NEVER AGAIN allow a Governor to abuse Emergency Powers.Do you agree?

Pledge to us that you are committed to restoring our Republic. Give us your word that, if elected, you won’t abuse the power of the office. The Never Again Bill would put the Governor in jail if he violated our rights again. There’s no better guarantee that you are on our side than making this your number one priority!

You see, we need action from these candidates. Simply flapping their gums isn't going to cut it anymore.

If they sign the pledge, that will be a mere indication they are at least somewhat serious about Ending Emergency Powers. However, we'll be watching them closely for double-speak and actions that prove otherwise.
